Terms and conditions

What we undertake to do, what we ask of you, and what happens when something goes wrong.

1. Who we are

Fidelito is operated by […], […], registered office at […]. Write to us at […].

Below, "we" means the company above, "you" means the person using the app or the business using the platform, and "shop" means the business where you collect your stamps.

2. What Fidelito is

Fidelito has two faces, and these terms cover both:

  • The customer app — free, permanently. One card, valid at every shop in the network.
  • The business platform — a dashboard and a scanning app for staff, on a monthly subscription.

We keep the record. The shop gives the reward.

3. Your account

You must be at least 16 to open an account. Below that age we cannot process the data without a parent's consent, and the app is not built for it.

The details you give us must be yours and accurate. Your password is yours — if somebody else signs in with it, what they do belongs to your account.

One account is one person. Do not share it or sell it.

4. Stamps and points are not money

Stamps and points are a record of your loyalty to one particular shop. They are not currency: they cannot be bought, exchanged for money, transferred between people, or moved from one shop to another.

The reward is the shop's promise, not ours. What we guarantee is that the count is correct and that the shop sees the same number you do. If a shop refuses a reward you earned, closes, or changes its programme, that is between you and the shop — we help with the evidence, which is the exact history of your transactions.

A shop may change or end its loyalty programme. Stamps collected until then stay visible in the app, and the shop keeps the obligation it took on before the change.

5. The subscription, for businesses

Prices are in Romanian lei, per month, and are shown in the app before you pay. Payment goes through Stripe. We never see or store your card number.

The subscription renews automatically each month until you stop it. Stop it whenever you like, from Settings → Plan → Card, invoices, cancel. Cancelling takes effect at the end of the period you have already paid for: you lose no days you paid for, and nothing shuts down mid-month.

We do not refund a month already begun, except where the law requires it.

If we change a price, we tell you at least 30 days beforehand by email. You can cancel before the new price applies.

If a payment fails, we say so in the dashboard and Stripe keeps retrying. The shop keeps working throughout — we do not stop the till at the counter over an expired card.

When a subscription ends you move to the free plan. Your data stays: customers, cards, history. Only the plan's limits change.

6. What is not allowed

  • Giving stamps for purchases that did not happen, to yourself or anyone else.
  • Using someone else's account, or someone else's card code.
  • Working around your plan's limits by technical means.
  • Scraping the platform, testing it for vulnerabilities without our written agreement, or using it to send unsolicited messages.
  • Using Fidelito for anything unlawful, or to mislead a shop's customers.

If that happens we may suspend the account. Where a business is involved we tell the people responsible for it first, unless doing so would make things worse.

7. Availability

We work to keep the platform up, and we build it to survive a bad connection — the staff app holds stamps given offline and sends them when the signal returns.

We do not, however, promise uninterrupted service. We carry out maintenance, sometimes announced and sometimes urgent. The services we depend on (Supabase, Stripe, the app stores) can have problems of their own.

8. Our liability

We are answerable for what we do: for the accuracy of the record, for the security of the data, and for keeping to these terms.

We are not answerable for the relationship between you and a shop, for the reward a shop promises, or for what a shop does with the data it sees about its own customers.

For a business, our total liability is limited to what you have paid us in the last 12 months. That limit does not apply to intent, gross negligence, or where the law does not permit it.

9. How it ends

You can delete your account at any time, from the app: Your account → Delete account. What happens next is described in the Privacy Policy.

We may close an account that breaks these terms, and we may discontinue the service with 60 days' notice, during which you can export your data.

10. Changes

When we change something material in these terms we tell you 30 days beforehand, by email or in the app. If you disagree, you can close your account before the change takes effect.

Small changes — a correction, a clarification — we make directly, and update the date above.

11. Law and courts

Romanian law applies. Disputes go to the competent courts at our registered office.

If you are a consumer you may also contact ANPC (anpc.ro) or the European online dispute resolution platform (ec.europa.eu/consumers/odr), and you keep the right to bring a claim before the court where you live.
